Terms of Service
1. Terms and Definitions
a. Place Equity:
Place Equity and any of its subsidiary entities.
b. You:
Any person or legal entity which makes use of services provided by Place Equity.
c. Community:
The set of all people and legal entities that make use of services provided by Place Equity.
d. Services:
This includes any functionality provided by Place Equity's website, currently found at http://www.place-equity.com. For example, it includes the ability to post and view content to and on the website.
e. Website:
This is the online website facilitated by Place Equity which can currently be found at http://www.place-equity.com. It includes any and all proprietary software composing the website.
f. User:
Any person or legal entity which maintains a user account with the Website.
g. Content:
This refers to the information uploaded to Place Equity's servers by You or the Community.
h. Software:
Any and all proprietary software written by Place Equity. It includes software used to maintain Place Equity's website.
i. Subscription:
The part of the Services whereby a User posts a listing on the Website in return for a periodic fee paid to Place Equity.
j. Subscription Term:
The time interval which constitutes a pay period during a Subscription.
k. Terms:
The terms and conditions set forth in this document.
2. Agreement to the Use of Services
  1. You must agree to the terms stipulated in this document before making use of the Services.
  2. If you do not agree to the terms in this document, you must not use the Services.
  3. Use of the Services implies your agreement with the terms of this document.
3. Termination of Subscriptions
  1. When a User is charged for a Subscription, this will occurr at the begining of the Subscription Term.
  2. Partial refunds for cancellation of a Subscription in the middle of a Subscription Term will not be granted. This rule is upheld in order to prevent Users from making use of Subscriptions without paying for their use.
  3. Subscriptions for Users that correspond to listings which are found to misrepresent the property associated with such listings may be terminated at Place Equity's sole discretion. This is done in order to maintain the integrity of the Content.
4. Rules For Posting Listings
  1. You agree not to post Content which misleads the Community about its associated listing(s) or which is otherwise fraudulent in nature.
  2. You agree not to post listings which contain information or advertisements not about the specific property associated with the listing. This includes Content which advertises 3rd-party companies, business entities, or the services they provide.
  3. You agree not to post listings which advertise multiple real estate properties within a single listing.
  4. Users who repeatedly attempt to post listings on the website which violate the Terms may have their accounts deactivated at Place Equity's sole discretion. Place Equity also reserves the right to disallow use of the Services to any person or entity which it has reason to believe will violate the Terms by making use of the Services.
  5. Any listings which are found by Place Equity to violate the Terms may be deactivated and removed by Place Equity.
5. Proprietary Information
  1. You agree not to reverse engineer, mass produce, distribute, redistribute, or sell any of the Software written by Place Equity without prior written contractual agreement.
  2. You understand that all intellectual property rights, including copyrights, trademarks, and proprietary information inherent in the design of the Software are legally and solely owned by Place Equity.
6. Nonseperability
  1. All terms of this document apply to the Software as well as to all of its component parts.
  2. By using the Software, you agree not to try to divide it into smaller parts for the purpose of infringing upon or working around the rights set forth within the Terms.
7. Severability
  1. In the event that any part or parts of the Terms are found to be legally unenforcible, the remaining parts of the Terms still constitute a legally binding agreement.
8. Restriction and/or Interuption of Services
  1. The Website will be taken offline only to perform maintenance required to ensure it's continued operability and/or enhancement of functionality. This is done at Place Equity's sole discretion, and does not require Place Equity to provide any sort of prior notification.
  2. In order to maintain the quality and accuracy of information stored in the Database, Place Equity may, at its sole discretion, place temporary restrictions on the actions allowed by your account. Usually, this is a result of:
    1. Parts of Content which were uploaded to the Website by You which, after censorship, will result in an improvement to the overall integrity and accuracy of the Content.
    2. Content deemed by Place Equity as being inappropriate or offensive, or which might otherwise detract from Place Equity's ability to provide the Services.
9. Passwords and Account Security
  1. You accept full responsibility for keeping secure any passwords you use in accessing your account through the Services. Place Equity will not be held reponsible for any loss or damages that result otherwise.
10. Limitations and Liability
  1. The Services obtained through use of the Website are provided "as is". You agree that Place Equity will not be held liable for any loss or damages which are due to bugs or mistakes in the implementation of the Services and which are in excess of the amount which You have paid to use the Services. Furthermore, if such bugs have been manifested in only a subset of the total number of listings which You have posted, then Place Equity will not be liable for more than the cost of this subset of listings.
  2. You agree to indemnify Place Equity for any loss or damages that result from the general misuse of the Services, including any loss or damages incurred as a result of misleading or fraudulent Content posted by members of the Community. At the same time, Place Equity will attempt to censure or remove fraudulent listings from the Content, and will also attempt to censure or remove listings which violate the Terms.
11. Rights Pertaining to Uploaded Content
  1. You retain any intellectual property rights inherent in the content uploaded by you to the Website. You agree to indemnify Place Equity with respect to loss or damages in the event that there is an infringement upon these rights by the Community or any 3rd-party.
  2. Place Equity and Place Equity alone reserves the right to maintain and sell peripheral services and/or software which provide access to Content. Any revenue gained from such sales will be the sole property of Place Equity.
12. Changes to the Legal Agreement
  1. Place Equity reserves the right to update and make changes to this document without any prior notice.
  2. Continued use of the Services implies an agreement with the current version of this document.
